These Terms and Conditions govern your use of the Damai Pelita website and your participation in our financial education programmes. By using this website or enrolling in a programme, you agree to be bound by these terms. Please read them carefully.
1. Definitions
- "Company", "We", "Us", "Our" refers to Damai Pelita, a financial education practice registered in Malaysia, located at 142 Jalan Tun Razak, 50450 Kuala Lumpur.
- "Programme" refers to any of the educational courses offered by Damai Pelita, including Setting the Time, Considered Investing After Forty, and Long-Horizon Retirement Engagement.
- "Participant" or "You" refers to any individual who uses this website or enrols in a Programme.
- "Content" refers to all materials, written summaries, course notes, and educational resources provided as part of a Programme.
- "Agreement" refers to these Terms and Conditions in their entirety.
2. Acceptance of Terms
By accessing this website or enrolling in a Programme, you confirm that you are at least 18 years of age, have the legal capacity to enter into this Agreement, and accept these Terms and Conditions in full.
If you do not agree with any part of these terms, please do not use this website or enrol in our programmes.
3. Description of Services
Damai Pelita provides financial education programmes in small-group and private formats in Kuala Lumpur, Malaysia. Our programmes are educational in nature. They do not constitute financial advice, investment advice, tax advice, or any form of regulated financial service.
Nothing communicated during a programme, in written materials, or through this website should be construed as a recommendation to buy, hold, or sell any financial product or security.
Our programmes are currently offered exclusively in person at our Kuala Lumpur premises. Availability is subject to cohort scheduling.
4. Enrolment and Programme Terms
Enrolment is confirmed upon receipt of full payment or agreed instalment schedule. Places are limited and allocated on a first-confirmed basis.
- You are responsible for attending sessions as scheduled. Missed sessions cannot generally be rescheduled within the same cohort.
- Written summaries are provided after each session as part of your enrolment. These are for your personal use only.
- For the Long-Horizon Retirement Engagement, sessions are scheduled by mutual agreement. Reasonable notice (minimum 48 hours) is required for rescheduling.
We reserve the right to postpone or reschedule a session or cohort due to unforeseen circumstances. In such cases, we will communicate as early as possible and offer equivalent alternative dates.
5. Your Responsibilities
When participating in our programmes and using this website, you agree to:
- Engage with programme content in good faith and for your personal educational benefit.
- Respect the confidentiality of other participants' circumstances discussed in group settings.
- Not record sessions (audio, video, or otherwise) without the prior written consent of Damai Pelita.
- Not reproduce, distribute, or share programme materials with third parties.
- Use this website only for lawful purposes and in a manner consistent with these terms.
6. Intellectual Property
All programme content, course materials, written summaries, and website content are the intellectual property of Damai Pelita or its licensors. You are granted a limited, personal, non-transferable licence to use materials provided to you as part of your enrolled programme for personal educational purposes only.
You may not reproduce, republish, share, sell, or otherwise distribute any programme materials without our prior written consent.
7. Payment and Refunds
All fees are quoted and payable in Malaysian Ringgit (RM). Current programme fees are:
- Setting the Time — RM 510
- Considered Investing After Forty — RM 1,940
- Long-Horizon Retirement Engagement — RM 2,820
Cancellation by participant: If you cancel your enrolment more than 14 days before the programme start date, you will receive a full refund less an administrative fee of RM 50. Cancellations within 14 days of the start date are non-refundable, though you may transfer your place to the next available cohort at no charge.
Cancellation by Damai Pelita: If we cancel a programme for any reason, you will receive a full refund of all fees paid.
8. Disclaimers
Damai Pelita provides educational programmes and general financial knowledge. We do not provide personalised financial advice, and nothing in our programmes, materials, or website constitutes advice regulated under Malaysia's Capital Markets and Services Act 2007 or any other financial services legislation.
Financial decisions made by participants following their programme are entirely their own. Damai Pelita accepts no responsibility for investment outcomes, financial losses, or decisions made by participants as a result of attending our programmes.
This website and its content are provided on an "as is" basis. We make no warranty regarding the accuracy, completeness, or suitability of information on this site.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Damai Pelita's total liability to you in connection with these terms or your participation in any programme shall not exceed the total fees paid by you for the relevant programme.
We are not liable for any indirect, incidental, special, or consequential losses arising from your use of this website or participation in our programmes, including any financial losses resulting from decisions made following programme attendance.
10. Termination
We reserve the right to withdraw a participant from a programme if their conduct is disruptive, disrespectful to other participants or staff, or in breach of these terms. In such cases, we will provide a pro-rata refund of unused sessions at our discretion.
You may withdraw from a programme at any time, subject to the refund terms in Section 7.
11. Governing Law and Disputes
These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
We encourage you to contact us directly in the first instance to resolve any concerns. Many disputes can be resolved quickly through direct communication. Please write to [email protected].
12. General Provisions
- Entire agreement: These terms constitute the entire agreement between you and Damai Pelita in relation to your use of this website and participation in our programmes.
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full effect.
- Waiver: Our failure to enforce any provision of these terms does not constitute a waiver of our right to enforce it subsequently.
- Assignment: You may not assign your rights under these terms to any third party without our prior written consent.
13. Changes to These Terms
We may update these terms from time to time. The revised terms will be published on this page with an updated date. For material changes affecting enrolled participants, we will provide notification by email. Continued use of this website after any update constitutes acceptance of the revised terms.
